ACT 114 S.B.

A Bill for an Act Relating to Public Lands.

Be It Enacted by the Legislature of the State of Hawaii:

SECTION l. Section 171-36.2, Hawaii Revised Statutes, is amended to read as follows:

''[{]§171-36.2[}] Public lands for graphic: strikethrough "urban" historic preservation and restoration.

(a) Any law to the contrary notwithstanding, the board may lease public lands in the State for use in graphic: strikethrough "urban"historic preservation and restoration projects:

( l ) Through negotiations: and

( 2 ) For a price which shall be determined by the board.

(b) The department shall adopt rules pursuant to chapter 91 to determine what constitutes graphic: strikethrough "urban"historic preservation and restoration projects for the purposes of this section; provided that no definition or criteria established shall conflict with any federal, state, or county law.

(c) All subleases of land disposed of pursuant to this section shall be subject to the approval of the board.''

SECTION 2. In amending title 13, subtitle l0, chapter 223, Hawaii administrative rules to conform with this Act, the department of land and natural resources shall be exempt from the public notice and hearing requirement of chapter 91, Hawaii Revised Statutes.

SECTION 3. Statutory material to be repealed is bracketed and stricken.

SECTION 4. This Act shall take effect upon its approval.
