Limited Existence Commission is an Agency Subject to the UIPA
The Commission on Sexual Orientation and the Law
("Commission") is a government "agency" as
defined by the UIPA. The 1994 Legislature created the Commission
and scheduled it to cease its
existence before the following year’s Regular Session. The
OIP concluded that, although the
Commission has a limited existence, the duration of its existence
"is not relevant when determining
whether the entity constitutes an ‘agency’ under the
UIPA." Therefore, the Commission must file a
public records report with the OIP in accordance with section 92F-18(b)
and (c), Hawaii Revised
Statutes.
